Terms and Conditions – Everything Electric 2024 Giveaway

1.1 Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
2. Promoter Details
2.1 The promoter is Fast Cities Australia Pty Ltd (trading as Evie Networks) (ACN 613 484 754) of Level 10/115 Pitt St, Sydney, 2000 (‘Promoter’).
3. Who can enter
3.1 Entry to win an Evie Home Charger is only open to residents of Australia aged eighteen years or over who do not reside in an apartment, and who satisfy the method of entry set out in clause 5 below.
3.2 Entry to win one of two $250 charging vouchers is only open to residents of Australia aged eighteen years or over who satisfy the method of entry set out in clause 5 below.
3.3 Employees of the Promoter and their immediate families, suppliers, associated companies and agencies are ineligible to enter. Persons under the age of 18 years are not able to enter. If a winner is discovered to be under 18, they will automatically be disqualified.
4. Promotional period
4.1 The promotion commences at 10:00 am AEST Friday 9 February and closes at 5:00 pm AEST on 11 February 2024.
5. Entry method
5.1 To enter, entrants must complete all of the following steps during the promotional period for each giveaway listed in 5.2 and 5.3 respectively.
5.2 To enter the giveaway to win an Evie Home Charger, entrants have to:
a) Fill in the entry form on: https://evie.com.au/ee24/ under “Win! An Evie Home Charger” during the promotional period.
b) To be considered a complete entry, entrants must fill in the mandatory fields, including name, email address and state, and click the “Submit” button on the website form. Incomplete entries will not be eligible for the giveaway.
c) Only one entry per person is permitted.
5.3 To enter the giveaway to win one of two $250 Evie charging vouchers, entrants have to:
a) Download the Evie app and create an account.
b) Fill in the entry form on: https://evie.com.au/ee24/ under “OR Win! A $250 Charging Voucher” during the promotional period.
c) If prior to the promotional period, they have already downloaded the Evie app and created an account, then they only need to fill in the form listed on 5.3 b).
d) To be considered a complete entry, entrants must fill in the mandatory fields, including name and email address, and click the “Submit” button on the website form. Incomplete entries will not be eligible for the giveaway.
e) Only one entry per person is permitted.
5.4 Entrants may only enter once. The entrant is eligible to win only either the Evie Home Charger or one of two $250 Evie charging vouchers and not both. By completing the entry method, the entry will receive one (1) entry.
5.5 By entering the promotion, the Participant agrees to be bound by the Promotor’s Terms of Service at https://evie.com.au/terms-of-service/
6. Prize details
6.1 The prize consists of either a Evie Home Charger or one of two $250 Evie public charging vouchers.
6.1.1 Evie Home Charger Prize:
a) 1 x 7kW single-phase EV smart charger; and
b) A Standard Metropolitan Installation of the EV smart charger. A Standard Metropolitan Installation is an installation within 50km of a state capital GPO and the charger must also be installed within 15m of the electrical distribution box (switchboard)
The Evie Home Charger Prize is valued at $2,295
6.1.2 Evie Charging Voucher Prize
a) One of two $250 Evie public charging vouchers valid for 12 months from activation

7. Prize conditions
7.1 Unless explicitly stated, All prizes are not transferable or exchangeable and cannot be taken as cash. No responsibility is accepted for any variation in the value of the prize
7.2 The winner consents to the Promoter organising photography and/or social media coverage around the winner’s usage of the prize.The winner agrees that any such photographs, electronic images, sound recordings or video footage may be used by the Promoter for an unlimited period in any media, or promotional, advertising or marketing materials, without any further notice or payment to the winner or their guest, including children.
8. Prize Draw and Notification of Winners
8.1 This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on the fulfilment of all entry requirements.
8.2 The judging will take place at the Promoter’s offices at Level 10/115 Pitt St, Sydney, 2000 on Tuesday 13 February 2024 commencing at 2:00 pm AEST. The decision will be at the absolute discretion of the Promoter and the Promoter’s decision will be final.
8.3 One (1) winning entry will be selected for the Evie Home Charger Prize and two (2) winning entries will be selected for the Evie Charging Voucher Prize.
8.4 Only the winners will be notified by via email, using the email address provided in their completed website form at https://evie.com.au/everything-electric-australia-2024-giveaway/
8.5 The winners must respond within 48 hours in accordance with clause 8.6 or the prize may be reallocated. Reallocation will be based on remaining valid competition entrants.
8.6 The winners must acknowledge acceptance of and claim their prize by replying to Evie Networks’ email, confirming his/her email address, mobile number and postal address. This information will be used to deliver the prizes accordingly.
8.7 If for any reason a winner does not acknowledge, accept and claim their prize by 9:00 AM AEST on Friday 16 February 2024, the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.
8.8 If a winner of a prize is under the age of 18 years, the prize will be forfeited by that entrant, and the next best entry will be awarded.
8.9 Evie Networks shall have no liability and is not responsible for any issues arising from a winner’s inability to receive emails. This includes but is not limited to, instances where messages may be affected by security settings or when winners provide incorrect or non-functioning contact information.
8.10 Prizes will be allocated based on the sole discretion of the judges. The Promoter’s decision is final and no correspondence will be entered into.
8.11 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence). If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in their sole discretion, to determine the identity of the entrant and to act on their determination.
8.12 The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
9. Prize Delivery
9.1 Upon acceptance and claiming of the prize(s) in accordance with these Terms and Conditions, the Winner(s) agree(s) to the following delivery procedures:
9.2.1 Evie Home Charger will be dispatched to the Winner’s designated address as communicated to the Promoter.
9.3 A $250 Evie Charging Voucher will be applied to the Evie charging account of the Evie Charging Voucher Prize Winner, linked to the email address shared with the Promoter.
9.3.1 Charging voucher winners should anticipate a processing time of 3-5 business days for the charging credit to reflect in their Evie Charging account.
9.3.2 A confirmation email will be sent directly to the Winner, verifying the successful application of the charging voucher to their account.
9.4 By participating in the competition, entrants acknowledge and accept these delivery terms. The Promoter reserves the right to amend these procedures as necessary in its absolute discretion.
10. No Liability
10.1 It is a condition of accepting any prize that the winner must comply with these Terms and Conditions, all the conditions of use of the prize and the prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.
10.2 The Promoter and its associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
10.3 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence). If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in their sole discretion, to determine the identity of the entrant.
10.4 The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct in relation to the promotion. 10.5 Unless explicitly stated, prizes are not transferable or exchangeable and cannot be taken as cash. No responsibility is accepted for any variation in the value of any prize.
10.6 In the event of war, terrorism, state of emergency or disaster, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion, or suspend or modify a prize.
10.7 If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
10.8 Nothing in these Terms and Conditions limits, excludes or modifies, or purports to limit, exclude or modify any applicable statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of or as a result of the promotion and/or a prize.
10.9 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes and is released from all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter); (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of and/or participation in a prize or the promotion.
10.10 Each winner indemnifies and releases the Promoter against any claims, losses and/or damages caused and/or suffered by the winner, its guest, and/or any person for whom the winner is responsible, in relation to this promotion and/or a prize.
10.11 The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information and authorising the use of such information as contemplated in these Terms and Conditions . The Promoter may, for an indefinite period, unless otherwise advised, use this information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant.
