EVIE MEMBERSHIP PLANS Terms and conditions

1. INTRODUCTION
1.1 These Terms and Conditions (“Terms”) govern the subscription and use of Evie’s Membership Plans (“Membership Plan”) offered by Fast Cities Australia Pty Ltd trading as Evie Networks (“Evie”, “we,” “us,” or “our”) in conjunction with Evie’s Terms of Service and Privacy Policy.
1.2 By signing up to the Membership Plan you (,” “you,” or “your”) agree to be bound by these Terms and Evie’s Terms of Service and Privacy Policy.
1.3 Please read these Terms carefully before signing up to the Membership Plan. If you do not agree with these Terms, you should not sign up to the Membership Plan.
2. MEMBERSHIP PLAN
2.1 Plan Description: The Membership Plan is a subscription service that provides registered Evie drivers with benefits, including discounted rates on EV charging services at Evie’s charging stations. Please refer to the Evie App for details of available Membership Plans.
2.2 Eligibility: The Membership Plan is available to individuals who:
- are at least 18 years of age;
- drive an electric vehicle; and
- have created a valid account with Evie.
2.3 Subscription Fee: Where required, participants in Membership Plans agree to pay a monthly subscription fee (“Subscription Fee”) as specified during sign up to the Membership Plan.
2.4 Billing Cycle: Where a Subscription Fee is associated with the Membership Plan, the Subscription Fee is billed on a monthly basis, with the first payment due upon sign up to the Membership Plan. The billing period runs for a calendar month from the date of sign up (e.g. if you sign up on July 15th, your billing period is July 15th to August 14th). Subsequent monthly payments will be automatically charged to your credit or debit card stored in the Evie App.
2.5 Membership Plan Use: The Membership Plan can only be used by you and benefit you, the individual holder of the Membership Plan, and your immediate household members that regularly share/use the same electric vehicle. It cannot be shared with any other person. If Evie becomes aware that the Membership Plan is shared with another person, it may terminate or suspend the Membership Plan immediately under clause 6.5.
2.6 Usage Thresholds: Certain plans may include kWh usage thresholds that must be met before discounts are applied. These thresholds:
- Are calculated within each billing period;
- Reset at the end of each billing period; and
- Must be met again in each new billing period to receive discounts
Example: Once you consume 100kWh within a billing period, you will receive a 5¢ discount on subsequent kWh until the end of that billing period. The threshold counter resets at the beginning of the next billing period.
If a kWh usage threshold is met mid-charge, then the associated discount will apply from the beginning of the next charge, so long as this charge falls within the current billing period.
3. MEMBERSHIP PLAN ACCOUNTS
3.1 Account Registration: To become a participant in a Membership Plan, you must be a registered Evie customer and sign up to a Membership Plan by providing accurate and complete information.
3.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
3.3 One Membership Per User: Each individual may maintain only one active Membership Plan at a given time.
3.4 Account Updates: You must promptly update your account information, including payment details, to keep it current and accurate.
4. MEMBERSHIP PLAN BENEFITS
4.1 Discounted Charging Rates: Participants in Membership Plans will receive the discounted per kWh rates (which will be calculated on Evie’s standard charging rates) at eligible charging stations within Evie’s public charging network.
4.2 Rate Information: Evie’s standard charging rates from time to time will be displayed in the Evie App.
4.3 Additional Benefits: We may offer additional benefits to participants in Membership Plans from time to time, which will be communicated through the Evie App or direct communications.
5. PAYMENT TERMS
5.1 Monthly Fee: Your Monthly Fee will be charged automatically to your designated payment method on a monthly basis. The first payment is due upon sign up to the Membership Plan. Subsequent payments will be taken out when the billing period renews each month. By signing up to the Membership Plan you authorise Evie to charge the Subscription Fee to your credit or debit card stored in the Evie App.
5.2 Payment Methods: Only credit cards and debit cards are accepted as payment methods for the Membership Plan. Alternative payment methods such as Apple Pay, PayPal, or other digital wallets are not currently supported.
5.3 Charging Fees: The relevant charging sessions will be billed at the discounted member rate and charged to your designated payment method.
5.4 Price Changes: We reserve the right to modify the Monthly Fee and charging rates with advance notice as specified in Section 8 (Changes to Terms).
5.5 Failed Payments: If we are unable to process your payment, your Membership Plan will be terminated. You will no longer receive any Membership Plan benefits after a failed payment.
5.6 Taxes: All fees and charges are subject to applicable taxes as required by law.
5.7 Promotions and Vouchers: If you have an Evie public charging voucher or other promotional offer on your Evie account, any kWh used with a 100% discount voucher will not count toward any Membership Plan kWh threshold
6. TERM AND TERMINATION
6.1 Term: The Membership Plan shall continue for the Plan Duration or until an earlier termination date.
6.2 Member Termination: You may cancel your Membership Plan at any time through the Evie App. When you cancel:
- You will continue to receive the Membership Plan benefits until the end of your then current billing period;
- Your Membership Plan will not renew for the following month; and
- No refunds will be provided for the then current billing period.
6.3 Plan Modifications: Membership Plans cannot be paused. You may only add or remove a plan. If you remove a plan and later wish to rejoin, it will be treated as a new Membership Plan with a new billing cycle.
6.4 Account Deletion: If you wish to delete your Evie account, you must first remove your Membership Plan from your account to ensure you will not be charged subsequent monthly fees. Once you do so, all Membership Plan benefits will cease immediately.
6.5 Evie Termination: We may terminate or suspend your Membership Plan with immediate effect if:
- You breach these Terms
- You misuse our charging stations
- You provide false or fraudulent information
- We discontinue the Membership Plan program
- Your payment method fails
6.6 Effect of Termination: Upon termination of your Membership Plan:
- You will no longer have access to the Membership Plan benefits, except for the remainder of the then current billing period in the case of voluntary cancellation as described in Section 6.2
- You will be charged the standard rate for future charging sessions
- No refunds will be provided for the current billing cycle
7. PRIVACY
7.1 Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
7.2 By signing up to the Membership Plan, you consent to the collection, use, and sharing of your information as described in Evie’s Privacy Policy.
8. CHANGES TO TERMS
8.1 Modifications: We reserve the right to modify these Terms at any time by posting the updated Terms on our website or Evie App and/or sending you a notification.
8.2 Notice Period: We will provide at least thirty (30) days’ notice before implementing any material changes that affect your rights or obligations.
8.3 Continued Use: Your continued use of the Membership Plan after the effective date of the revised Terms constitutes your acceptance of such changes.
8.4 Rejection of Changes: If you do not agree with the revised Terms, you must cancel your Membership Plan before the effective date of the changes.
9. MISCELLANEOUS
9.1 Entire Agreement: These Terms, together with Evie’s Terms of Service and Privacy Policy, constitute the entire agreement between you and the Evie regarding the Membership Plan. In the event of a conflict between these Terms and Evie’s Terms of Service, the Terms of Service shall prevail.
9.2 Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
9.3 No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
9.4 Assignment: We may assign our rights and obligations under these Terms. You may not assign your rights or obligations without our prior written consent.
9.5 Force Majeure: We shall not be liable for any failure to perform our obligations due to causes beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, strikes, or shortages of energy.
