Brisbane International Giveaway Terms and Conditions

  1. Standard Terms
    1.1 Information on how to enter and the prizes form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.
  2. Promoter Details
    2.1 The promoter is Fast Cities Australia Pty Ltd (trading as Evie Networks) (ABN 58 613 484 754). of Level 10/115 Pitt St, Sydney, 2000.
  3. Who can enter
    3.1 Entry is only open to residents of Australia aged eighteen years or over who satisfy the method of entry set out in clause 5 below. Employees of the Promoter and their immediate families, suppliers, associated companies and agencies are ineligible to enter. Persons under the age of 18 years are not able to enter. If a winner is discovered to be under 18, they will automatically be disqualified.
  4. Promotional period
    4.1 The promotion commences at 6:00 pm AEST Friday 8 December and closes at 11:59 pm AEST on 14 December 2023.
  5. Entry method
    5.1 To enter, entrants must complete all of the following steps during the promotional period:
    a) Follow the Evie Networks Facebook Page (located at www.facebook.com/evienetworks);
    b) Like the promotional post (https://www.facebook.com/share/p/dugg6745SdJnx1mv/?mibextid=WC7FNe); and
    c) In a comment on the promotional post, tag a friend and let us know in 25 words or less, who you’d love to share the Tennis coaching tickets with and why.

    5.2 Entrants may enter multiple times provided each entry is submitted separately in accordance with the entry instructions above. Each entry must contain a different friend tagged. The entrant is eligible to win a maximum of one (1) prize. By completing the entry method, the entrant will receive one (1) entry.

  6. Prize details
    6.1 First Prize
    – 2x Ground Pass tickets to Brisbane International held on Wednesday 3 January 2024 at Queensland Tennis Centre – 190 King Arthur Terrace, Tennyson QLD 4105. ($25 each)
    – 2x Experiences Program Tickets at Brisbane International held on Wednesday 3 January 2024 at Queensland Tennis Centre – 190 King Arthur Terrace, Tennyson QLD. The experience program (coaching clinic plus behind-the-scenes tour) is a money can’t buy experience. The experience program includes: 1x 45-minute Coaching Clinic: The winner and their guest will get the opportunity to step onto a court with a Tennis Australia coach to get put through their paces in a tennis clinic.
    – 1x behind-the-scenes tour: The winner and their guest will get an exclusive behind-the-scenes tour at the Brisbane International.
    – 1 x $2,000 Flight Centre Voucher (to be used towards flights and accommodation to attend the Brisbane International 2024).
    – 2x Tennis Racquets (around $100 each).
    – 2x Tennis Ball Packs (around $15 each).

    The First Prize is valued at up to $2,300
    The one (1) best valid entry, as determined by the judges, will win the First Prize.

    6.2 Second Prize
    – 2x Ground Pass tickets to Brisbane International held on Wednesday 3 December 2024 at Queensland Tennis Centre – 190 King Arthur Terrace, Tennyson QLD 4105. ($25 each).
    – 2x Experiences Program Tickets at Brisbane International held on Wednesday 3 January 2024 at Queensland Tennis Centre – 190 King Arthur Terrace, Tennyson QLD. The experience program (coaching clinic plus behind-the-scenes tour) is a money can’t buy experience. The experience program includes: 1x 45-minute Coaching Clinic: The winner and their guest will get the opportunity to step onto a court with a Tennis Australia coach to get put through their paces in a tennis clinic. 1x behind-the-scenes tour: The winner and their guest will get an exclusive behind-the-scenes tour at the Brisbane International.The winner of the Second Prize has the option to transfer the 2x Ground Pass tickets and 2x Experience Program tickets to another person. The Ground Pass Ticket and Experience Program tickets must be allocated to the same person; the winner cannot transfer 2x Ground Pass tickets to one person, and 2 Experience Program tickets to another person. To transfer the tickets, the winner must notify Evie Networks by one the following methods; email info@evie.com.au or send a Facebook Direct Message to Evie Networks. The winner must notify Evie of this request via one of these methods within 48 hours of being notified as the Winner, and must provide the contact details of the person they wish to transfer the tickets to, including their first name, last name, email address and contact number.

    – 1x $100 Evie Charging Voucher

    The Second Prize is valued up to $350
    The one (1) second-best valid entry, as determined by the judges, will win the Second Prize.

    6.3 Third Prize
    – 2x Tennis Racquets (around $100 each)
    – 2x Tennis Ball Packs (around $15 each)
    – 1x $100 Evie Charging VoucherThe Third Prize is valued up to $350

    The two (2) third and fourth-best valid entries, as determined by the judges, will win the Runner Up prize.

    6.4 The total prize pool is valued up to $3,000

    6.5 All prize values in this section are estimates only.

  7. Prize Conditions
    7.1 The First Prize winner will be required to arrange their own flights and accommodation using the $2,000 Flight Centre Voucher to attend Brisbane International 2023. Accommodation bookings made using the Prize are subject to terms and conditions detailed here: https://help.flightcentre.com.au/s/article/booking-terms-conditions-au

    7.2 The Prize travel is subject to availability at the time of booking. Evie Networks is not responsible for any cancellation, delay or rescheduling of flights, and any costs incurred as a result (including, without limitation, accommodation costs) will be the sole responsibility of the winner.

    7.3 Flights and accommodation are not included in the Second Prize and therefore, the winner of the second prize must organise their own flights and accommodation.

    7.4 Additional costs such as transfers to and from airport departure points, transfers to and from accommodation to the Queensland Tennis Centre venue, insurance, items of a personal nature, additional spending money and all other ancillary costs are not included in any of the prizes.

    7.5 Unless explicitly stated, All prizes are not transferable or exchangeable and cannot be taken as cash. No responsibility is accepted for any variation in the value of the prize. If the prize includes travel and accommodation it is the responsibility of the winner to liaise with the prize provider if cancellations or changes are made by the provider. The Promoter is not responsible for any cancellations or changes to bookings. Transport to and from an event and all other ancillary costs are the responsibility of the winner.

    7.6 The Ground Pass Tickets and Experience Program tickets are both subject to Tennis Australia’s Terms and Conditions. First Prize and Second Prize Winners and respective guests therefore consent to the ‘Conditions of Sale and Entry’ for the Brisbane International event.     7.7 The winner of the First Prize and Second Prize, and their respective guests – the person they share the ticket with – both consent to the promoter and Tennis Australia Limited using their personal information and photographing/recording images taken while they’re participating in any activity or event run or organised by Tennis Australia which constitutes part of the Prize. The winner and the guest agree that any such photographs, electronic images, sound recording or video footage may be used by the Promoter or Tennis Australia for an unlimited period in any media, or promotional, advertising or marketing materials, without any further notice or payment to the winner or their guest, including children.

  8. Prize Draw and Notification of the Winners
    8.1 This is a game of skill and chance plays no part in determining the winners. Each entry will be individually judged based on the fulfilment of all entry requirements, in addition to the originality and creative merit in the tell us in 25 words or less, who you’d love to share the Tennis coaching tickets with and why comment on the promotional post.

    8.2 The judging will take place at Fast Cities Australia Pty Ltd (trading as Evie Networks) Level 10/115 Pitt St, Sydney, 2000 on Friday 15 December 2023 commencing at 2:00 pm AEST.
The decision will be at the absolute discretion of the Promoter and the Promotor’s decision will be final.

    8.3 One (1) winning entry will be selected for the First Prize, one (1) winning entry will be selected for the Second Prize and two (2) winning entries will be selected for the Runner-Up Prize.

    8.4 Only the winners will be notified by Facebook direct message that they won. The winners must respond within 48 hours in accordance with clause 8.5 or the prize may be reallocated. Reallocation will be based on remaining valid competition entrants.

    8.5 The winners must acknowledge acceptance of and claim their prize by replying to Evie Networks’’ Facebook direct message, providing his/her email address, mobile number and postal address. This information will be used to deliver the prizes accordingly.

    8.6 If for any reason a winner does not acknowledge, accept and claim their prize by 9:00 AM AEST on Monday 18 December 2023,  the prize will be forfeited by the winner and cash will not be awarded in lieu of the prize.

    8.7 If a winner of a prize is under the age of 18 years, the prize will be forfeited by that entrant, and the next best entry will be awarded.

    8.8 Evie Networks shall have no liability and is not responsible for any issues arising from a winner’s inability to receive Facebook direct messages. This includes but is not limited to, instances where messages may be affected by security settings or when winners provide incorrect or non-functioning contact information on Facebook.

    8.9 First Prize, Second Prize and Runner-Up prizes will be allocated based on the sole discretion of the judges. The Promoter’s decision is final and no correspondence will be entered into.

    8.10 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence). If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in their sole discretion, to determine the identity of the entrant and to act on their determination.

    8.11 The Promoter reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

  9. Prize Delivery
    9.1 Upon acceptance and claiming of the prize(s) in accordance with these Terms and Conditions, the Winner(s) agree(s) to the following delivery procedures:

    9.2 Ground Pass Tickets and Experience Program Tickets will be electronically delivered via email to the address provided to Evie Networks.

    9.3 Tennis Racquets and Tennis Ball Packs will be dispatched to the Winner’s designated address as communicated to Evie Networks.

    9.4 A $100 Evie Charging Voucher will be applied to the Winner’s Evie Charging account, linked to the email address shared with Evie Networks.

    9.4.1 Charging voucher winners should anticipate a processing time of 3-5 business days for the charging credit to reflect in their Evie Charging account.

    9.4.2 A confirmation email will be sent directly to the Winner, verifying the successful application of the charging voucher to their account.

    9.5 By participating in the competition, entrants acknowledge and accept these delivery terms. The Promoter reserves the right to amend these procedures as necessary in its absolute discretion.

  10.  No Liability
    10.1 It is a condition of accepting any prize that the winner must comply with these Terms and Conditions, all the conditions of use of the prize and the prize supplier’s requirements. Each prize must be taken as stated and no compensation will be payable if a winner is unable to use the prize as stated.

    10.2 The Promoter and its associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.

    10.3 The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence). If there is a dispute as to the identity of an entrant, the Promoter reserves the right, in their sole discretion, to determine the identity of the entrant.

    10.5 Unless explicitly stated, prizes are not transferable or exchangeable and cannot be taken as cash. No responsibility is accepted for any variation in the value of any prize. If the prize includes travel and accommodation it is the responsibility of the winner to liaise with the prize provider if cancellations or changes are made by the provider. The Promoter is not responsible for cancellations or changes to bookings. Transport to and from an event and all other ancillary costs are the responsibility of the winner.

    10.6 In the event of war, terrorism, state of emergency or disaster, the Promoter and/or Evie Networks reserve the right to cancel, terminate, modify or suspend the promotion, or suspend or modify a prize.

    10.7 If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter and/or Tennis Australia, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

    10.8 Any cost associated with accessing a Facebook account is the entrant’s responsibility.

    10.9 Entry and continued participation in the promotion is dependent on entrants following and acting in accordance with Facebook’s Terms of Use which can be viewed at https://m.facebook.com/legal/terms

    10.10 Nothing in these Terms and Conditions limits, excludes or modifies, or purports to limit, exclude or modify any applicable statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

    10.11 Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and Tennis Australia (including its respective officers, employees and agents) is not responsible for and excludes and is released from all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter); (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or entrant; or (f) taking/use of and/or participation in a prize or the promotion.

    10.12 Each winner indemnifies the Promoter and Tennis Australia against any claims, losses and/or damages caused by the winner, its guest, and/or any person for whom the winner is responsible, in relation to this promotion.

    10.13 This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants understand that they are providing their information to the Promoter and Tennis Australia, and not to Facebook. The information an entrant provides will only be used for the purposes outlined in these Terms and Conditions. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook. Facebook will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of the prize), except for any liability which cannot be excluded by law.

    10.14 The Promoter collects personal information in order to conduct the promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information and authorising the use of such information as contemplated in these Terms and Conditions . The Promoter may, for an indefinite period, unless otherwise advised, use this information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant.
